Terms of Service

These terms apply to the marketing services offered at torek.trade/marketing by Torek, ABN 41 124 813 799, based in New South Wales, Australia (“Torek”, “we”, “us”).

By ordering a service or submitting an enquiry, you agree to these terms.

Two services:

Creative. We build product photography scenes using product photos you supply. Prices are published on torek.trade/marketing. Two revisions per photo are included. Turnaround is 1 to 3 business days, or 5 business days for orders of 10 photos or more, from the point we have everything we need from you.

Full marketing. We plan, build and manage advertising campaigns on Meta or Google platforms. Priced on scope and ad budget, quoted individually.

You are responsible for the product photos and other material you give us. By sending them, you confirm that you own them or have permission to use them, and that we can use them to produce your order.

If someone makes a claim against us because of material you supplied, you agree to cover our reasonable costs in dealing with it.

We do not check the ownership of material you send us.

When your order is paid, you can use the finished images however you like for your own commercial purposes, with no time limit and no additional fee.

We may show the work we produce for you as part of our own portfolio, on our website or social accounts. If you would rather we did not, tell us in writing and we will not.

Two revisions per photo are included. A revision means an adjustment to a scene we have already produced. A request that changes the brief, the product, or the concept is a new photo and is charged as one.

Full marketing runs on a two month minimum term, then continues month to month.

The reason is practical rather than commercial: the opening weeks of a campaign are spent testing audiences and creative to find what works, and a campaign stopped inside that window produces test data and no result.

After the minimum term it continues month to month. You can stop any time before your next monthly payment. You keep the month you have already paid for, and we finish out that month’s work.

Ad spend is separate from our fee and is always paid by you, directly to the advertising platform, on an account you own and control.

We never hold, invoice or receive your ad spend. If you stop paying the platform, the campaign stops, and that is between you and them.

You keep access to your own ad account at all times, including after we stop working together.

We do not guarantee any particular advertising result. We cannot promise a level of sales, reach, cost per result, or return on ad spend, and nothing we say in a quote, a call or a message should be read as a promise of one.

Advertising performance depends on your product, your pricing, your market and platform factors outside our control.

Creative orders are paid up front through Stripe. Full marketing is invoiced monthly in advance.

We do not receive or store your card details. Payments are handled by Stripe.

Prices are in Australian dollars.

Refunds are covered in our Refund Policy, which forms part of these terms.

To deliver on time we need the material we have asked for. If we are waiting on you, turnaround times pause until we have it.

For full marketing we will need access to your advertising accounts. You are responsible for granting and maintaining that access.

You can cancel a creative order before we begin work. Once work has begun, see the Refund Policy.

We may decline or end work if the material you supply infringes someone else’s rights, if the product cannot lawfully be advertised on the relevant platform, or if payment fails.

Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law, including the consumer guarantees. Where we are permitted to limit our liability, our total liability to you is limited to the amount you have paid us for the service in question.

We may update these terms. The version published at the time you place an order is the version that applies to that order.

These terms are governed by the laws of New South Wales, Australia.
